Prodejní automaty legislation: what to verify before launch

Prodejní automaty touches several legal areas at once. Duties vary by country, assortment, payment method, location and by whether you act as manufacturer, distributor or operator. This page is a practical roadmap, not legal advice.

Start by defining exactly what the machine sells.

Different rules apply to packaged snacks, fresh food, beverages prepared inside the machine, cosmetics, supplements, alcohol, tobacco, medical devices or medicinal products. For regulated categories, do not assume ordinary retail rules automatically translate to unattended vending.

EU baseline

Core areas that recur across the EU

EU rules create the baseline, while national law often adds registration, enforcement, hygiene, licensing, age restrictions or local operating duties.

Regulation (EC) 852/2004

Food hygiene

HACCP, hygiene procedures, cleaning, temperature control, process traceability and operator responsibility.

Official source ↗

Regulation (EU) 1169/2011

Food information

Name, ingredients, allergens, quantity, durability, storage and other mandatory information depending on the product. Automatic vending has specific exceptions and national overlays.

Official source ↗

Directive 98/6/EC

Consumer pricing

Prices must be unambiguous, easily identifiable and clearly legible; unit pricing and discount communication rules may also apply.

Official source ↗

EU consumer acquis

Consumer protection

Customers should know who is selling, what they pay, how to obtain a receipt, submit a complaint and contact the responsible operator. National law adds detail.

Official source ↗

Regulation (EU) 2025/40 — PPWR

Packaging and waste

From 12 August 2026 PPWR applies as the new EU framework for packaging and packaging waste, including prevention, labelling, reuse, refill and producer responsibility.

Personal data and digital services

Where apps, loyalty, cameras, payment systems or analytics process personal data, legal basis, transparency, retention, security and processor agreements must be addressed.

What an operator should verify for every machine

National layer: where to start checking

This is not an exhaustive legal index. It is a practical list of authorities and topics to review before installing a machine or expanding the assortment.

CZ

Czech Republic

Food: Ministry of Agriculture / CAFIA / regional public-health authorities depending on the activity. Consumer matters: Czech Trade Inspection Authority. Business licensing: trade-licensing authorities. Also review receipts, pricing, operator identification, hygiene, assortment and local placement conditions.

Official starting point ↗
SK

Slovakia

Food and hygiene: competent food-control and public-health authorities. Consumer matters: SOI. Business and permits: slovensko.sk and competent authorities. Also verify national receipt/eKasa rules for the specific sales model.

Official starting point ↗
DE

Germany

In addition to food, pricing and consumer rules, review VerpackDG/PPWR, packaging registration and reusable/refill duties. Germany’s 2026 VerpackDG includes §61 specifically addressing vending machines.

Official starting point ↗
AT

Austria

Review Gewerbeordnung, food and hygiene duties, price display, packaging and rules of the relevant federal state or municipality. RIS is the primary legal portal.

Official starting point ↗
PL

Poland

Review food and sanitary rules, consumer rights, business registration, packaging and local conditions. gov.pl and ISAP are useful official starting points.

Official starting point ↗
EU

Cross-border operation

If one operator works in several countries, do not rely on one universal template. Registration, tax, packaging, receipts, consumer communication, age limits and local enforcement differ.

Official starting point ↗
By assortment

The more sensitive the product, the less a generic retail checklist is enough

Split compliance by product category. This greatly reduces the risk of loading a machine with goods for which unattended sale is unsuitable or unlawful.

Lower risk

Packaged snacks and drinks

  • Labelling and allergens
  • Expiry and storage
  • Price and complaints
  • Packaging / EPR
Higher operating burden

Fresh food and machine-prepared beverages

  • HACCP
  • Temperature chain
  • Sanitation and water
  • Ingredients and allergens
Regulated

Pharma and healthcare

  • Legal product status
  • Who may sell
  • Dispensing model
  • Supervision / identification
Age control

Alcohol, tobacco and other restricted goods

  • Whether vending is permitted
  • Reliable age verification
  • Local placement restrictions
  • Advertising and promo rules
Digital layer

Payments, loyalty, apps and cameras add another compliance layer

Once the machine interacts online, collects data or uses cameras or personalisation, compliance extends beyond physical retail.

Payments

Use a trusted payment provider, define failure states, reversals and refunds and keep payment data separated from the ordinary application where possible.

Loyalty / CRM

Explain what data is collected, why, how long it is kept and how an account or marketing consent can be managed.

Camera / AI

Security cameras, queue analytics, demographic estimation or age verification may have very different legal treatment. Purpose assessment and data minimisation are essential.
